One of the Valley’s millionaire restaurant entrepreneurs is accused of defrauding investors out of millions for personal gain, including using funds for a home, out-of-state real estate and an $8 million private airplane.
Aaron Wagner, a part-time Scottsdale resident planning to open restaurants in Gilbert and Scottsdale, was arrested by FBI agents on Oct. 24 in Salt Lake City, Utah.
Wagner and his business partner, Michael Mains, face 16 counts, including four counts of wire fraud, one count of conspiracy to commit wire fraud, six counts of transactional money laundering, and five counts of concealment money laundering.
Since at least 2021, Wagner, Mains and unnamed co-conspirators allegedly ran Ponzi-like schemes, tricking investors into sending millions to entities they controlled, according to the U.S. Attorney’s indictment.
The indictment states that instead of funding restaurants and other businesses as promised, the money was diverted for personal gain or used to maintain the appearance of success for earlier investors.

Wagner also allegedly misrepresented his background to investors to gain trust.
“He would tell a story of growing ‘from sports reject and broke college kid to playing the Rose Bowl to becoming a billion-dollar portfolio manager.’ But Wagner never played in the Rose Bowl, and he never managed a billion-dollar portfolio,” the indictment read.
Prosecutors say Wagner and Mains used investor funds to make down payments on a $4 million Scottsdale home, the private airplane and an $8 million real estate property in Missoula, Montana. Some funds were also reportedly redirected to Swags, Wagner’s planned Scottsdale high-end restaurant, which was sold shortly after his arrest.
When past investors and employees complained about Wagner online, some had their social media accounts suspended. Court documents allege that Wagner coerced social media companies into deleting accounts of his critics and, in one instance, used a fake death certificate of a former investor to have their profile removed.
Prosecutors argued Wagner should remain in custody, citing his private plane access, pilot’s license and Canadian citizenship, which would allow him to travel on a non-U.S. passport. However, the court released Wagner on his own recognizance with GPS monitoring. His trial is scheduled for Feb. 3.
What was Wagner planning in Scottsdale?
Before his arrest, Wagner was working on establishing Swags in Scottsdale’s Entertainment District.
Wagner had purchased the property on East Shoeman Lane for $4.5 million, spending on engineering, planning and legal fees as he navigated local opposition to his proposed three-story restaurant, according to a Scottsdale City Council meeting held in early January.
However, despite securing a 4-3 vote in his favor from the council, Swags failed to obtain the required “super majority” needed for its rezoning, stalling the project.
The project’s most vocal opponent had been nightclub owner Shawn Yari, who is developing a neighboring hotel and raised concerns about noise and parking impacts.

PHOENIX – Arizonans approved a ballot measure to enshrine abortion rights in the state constitution, according to a call by the Associated Press.
Since 2022, Arizona has enforced a law banning abortions after the 15th week of pregnancy. Proposition 139 will amend the state constitution to guarantee abortions access up to the point of fetal viability — around 24 weeks. The measure also allows exceptions for abortions beyond the point of viability to protect the life or physical or mental health of the pregnant person.
Opponents decried the measure as dangerously broad. They argued the state’s abortion law already allowed enough access, since most abortions take before the 15th week of pregnancy, and said current restrictions made reasonable exceptions for miscarriages and pregnancy-related medical emergencies.
But supporters said the 15-week law created traumatic obstacles for women facing complications later in pregnancy and forced some women to leave the state for abortions.
Arizona is one of 10 states where abortion was on the ballot this year.
Multiple polls leading up to Election Day suggested the measure had enough support among voters to pass.
“I’ve always felt that once we were on the ballot we would win because our position is really popular,” said Chris Love, a spokesperson for the amendment effort.
To qualify for ballots, supporters of the citizen-led initiative gathered over 800,000 signatures — more than double the required threshold — and raised $32 million — 25 times more than opponents raised.
Arizona’s 15-week abortion law is expected to fall once the new constitutional amendment goes into effect.
But Arizona has dozens of other laws on the books regulating abortion. There’s a required 24-hour waiting period for patients, a law barring abortion medication through the mail and a requirement that patients have an ultrasound before the procedure, which may be medically unnecessary. Those laws are now likely to be challenged in court.
“There will be a lot of litigation trying to figure out exactly what it means,” said Barbara Atwood, professor of law emerita at the University of Arizona. “There will be a period of some uncertainty about which of the existing laws – on informed consent, waiting periods, the 15-week law itself — whether those will stand under the new constitutional provision.”
