Short-term rentals, like Airbnbs, will now be limited to room rentals, as opposed to whole-house rentals.
MATTHEWS, N.C. — After months of back and forth, the town of Matthews has officially updated its ordinance relating to short-term rentals.
The Board of Commissioners voted unanimously Monday night to adopt new restrictions, as outlined in the agenda.
The changes impact Matthews Unified Development Ordinance (UDO). The UDO previously did not have a definition for short-term rentals. Now, they're included in the "Bed & Breakfast" section.
Those rentals will also be limited to room rentals, as opposed to whole-house rentals.
This is something long-term resident Patricia Robinson has been pushing for for months, since WCNC Charlotte first spoke with her in February.
"It's just been a nightmare," Robinson said. "It's been, it's just not a good thing for Matthews."
She decided to push for more restrictions after her daughter and son-in-law began having repeated issues with short-term rentals in their neighborhood.
"Even downtown is one thing, but not right next door to families," Robinson said. "It's not safe. You got little kids. We got kids all over our neighborhood, and you got these strangers coming in. You don't know who they are. And like I said, the Airbnb next door to my daughter, it's like a hotel."
However, Airbnb owner Ian Goldstein isn't happy.
"We're in the 96% occupancy rate," Goldstein said. "People love it, and they love the Town of Matthews, and they want to come visit."
His short-term rental is grandfathered in and will not be impacted by the new rule. However, whole-house rentals like his won't be able to open in the future.
He said this is a big problem for the future of Matthews' growth.
"The millennial generation of bed and breakfast is here. Do you want it in Matthews?" Goldstein said.
He added he expects the town will face litigation after this decision.

The town called CSX's demands "indefensible" after requesting 162 times more for a parking lease.
MATTHEWS, N.C. — The Town of Matthews could see some changes to nearly 200 parking spaces currently free to the public in its downtown area.
As of Friday, a lease agreement the town has with the CSX rail and transportation company comes to an end, and those parking spaces could be turned over to a private company.
Right now, parking in downtown Matthews is free. With the end of a contract with CSX Matthews will no longer have the rights to the parking spaces along the track. Those are spaces the town has leased for over 30 years.
Downtown Matthews is a bustling community filled with shops and restaurants.
“This is the type of downtown I bring my family to, my kids,” said Matt Ferrie, the General Manager for Carolina Beer Temple. “I live two miles from here, this is my community too and this is really frustrating.”
All of the parking staying free to visitors is a priority for town leaders.
“It just helps to create a vibrant business community that is so important to the health and wellbeing of our community,” said Becky Hawke, Matthews’ town manager.
But changes are coming. Since 1991, Hawke said they have leased 196 parking spots from CSX along the tracks.
“They contacted us without prior notice and said they had received an unsolicited offer from a paid parking company,” said Hawke. “And if we didn’t want to lose all of these parking spaces, we would have to beat their offer.”
The offer on the table is $130,000 compared to the $800 the town paid annually. That is 162 times more.
CSX railroad sent this statement to WCNC Charlotte:
We can confirm that CSX received an unsolicited offer from a third party to lease the subject property that included better liability and indemnity protection for CSX. While discussing the new offer with the town of Matthews, CSX was unable to reach a mutually beneficial agreement.
With no resolution, the lease comes to an end effective October 11, 2024.
Hawke said the town has invested hundreds of thousands of dollars in development, maintenance, and beautification of the free parking spaces.
“We provide all of the flowers, all of the landscaping, all of the maintenance,” said Hawke. “We continually repave it. We added the lighting and walkway where it’s needed.”
Hawke said the town was blindsided.
“We had originally been told that if we did not agree to their terms that we would have until the end of the calendar year for anything to turn over," said Hawke. "But they backed that date up.”
Town officials called the rail company's demands "indefensible". According to the town website, in addition to the staggering increase in cost, the proposal included a 3% annual increase and a 30-day cancellation clause, allowing CSX to demand more money from the town at any time in the future with very little notice.
Neighbors like Matt Ferrie are not thrilled about the news.
“It throttles the entire downtown,” said Ferrie. “These are prime spots for literally every business, every aspect of downtown and they are taking that away.”
“There are a lot of stores and restaurants that we frequent so are used to the parking that is unpaid,” said Marissa Vincent while out for a walk. “I think a lot of families are going to feel the impact. It’s already hard to find parking as it is.”
Town leaders said they are not going down without a fight and looking at every avenue to continue to keep all parking downtown free.
“Our goal is to keep every space in downtown Matthews free for public use,” said Hawke.
In the meantime, the town is already working to develop more lots in the area. One will open 48 free spaces and another 35 while they weigh all their options.
“In that in between, we are telling people to proceed as they always have and if the space available to continue to use them,” said Hawke.

MATTHEWS, N.C. (WBTV) - A dispute between CSX Railway and the Town of Matthews has put the future of hundreds of free parking spaces in downtown jeopardy.
According to the Town of Matthews and a statement from CSX Rail, CSX recently received an offer from a third party to lease the property where the parking spots are currently located along the roadway in downtown Matthews. In a statement, CSX said:
“We can confirm that CSX received an unsolicited offer from a third-party to lease the subject property that included better liability and indemnity protection for CSX. While discussing the new offer with the Town of Matthews, CSX was unable to reach a mutually beneficial agreement.”
Town officials, including Town Manager Beck Hawke, said the rail company told the town that they would need to pay $130,000 a year to keep the spots as they currently are.
Previously the town had paid $800 a year to lease the land.
“When the numbers were coming in from CSX that were a 16,000% increase over what we’ve been paying,” Manager Hawke said, “They [Board of Commissioners] said that this is just not a good use of taxpayer dollars. Is there a way for us to pivot and provide other free options that we can also have longer term stable agreements with, that people can count on, so that we’re not subject to the whims of a company that doesn’t need the money, but is choosing to try to elect this option?”
The board voted 7-0 to not pay $130,000 and to not create paid parking in the town.
“It was 7-0, without hesitation for us to follow the path that we’re now following,” Manager Hawke said. “There is zero interest in having paid parking in downtown Matthews and the board intends to follow every reasonable course of action to try to prevent that from ever coming to fruition.”
They have been working to find alternative parking solutions, including negotiating with nearby businesses to provide additional free parking spaces.
As of the writing of this article, Matthews had arranged about 40 new free parking spots with another 50 to be added within a week.
Manager Hawke said the long term plan is to create enough new spaces to offset the loss of any free parking caused by this situation.
“What we’re doing is investing our dollars and activating some 35 new spaces on North Fremont Street, which helps support that side of Trade Street,” Manager Hawke said. “And then we’ve got 48 spaces that will be open by the end of next week, behind White Duck Taco, which is just down Charles Street. And so from that perspective, maybe it’s a different block, or maybe it’s walking in a different direction than you used to always be able to but it’s still free, and it’s still safe and it’s still accessible…We hope to be able to win the fight with CSX and keep the existing spaces free, which, at the end of the day, would just be good for everybody, but regardless of how it plays out with CSX, then there are always free, plentiful options for people down downtown.”
The future of the parking spaces remains uncertain, as CSX has not publicly disclosed its plans for the property.
The town is urging CSX to reconsider its decision and work toward a solution that benefits both parties.
